It is illegal to conceal carry a dirk, bowie knife, switchblade, machete, ballistic knife, darts, or any knife of a like kind. It is legal to open carry any type of knife. KEEP IN MIND: You should be perusing self defense tactics without weapons. Be strong without the use of weapons.
No swords...got it.
Only word of advice I have for yals is DO NOT GET ARRESTED IN VA. There are some shitty states to get arrested in VA is one of them. They will nail you to the wall any chance they get and many counties have over a 99% conviction rate.
So I can't bring my katana/trench-coat/fedora outfit
Jeez why even go
Surprised antifa is even gonna be there with the no masks rule
They don't dare show their face up here
If not I become the Charlottesville PD
@Aaron - VA It's hard to say when the city council is comprised of BLM and Antifa activist.
If it happens that'd be a serious legal issue they would be going against. It won't happen.
Unless they want to go to court
I'm just not putting much faith in the city leadership for obvious reasons.
Let them come with masks and it be okay with the PD .So we can fund millions to our movement
It is legal to conceal carry a handgun (with proper permit) at the event location. It is also legal to open carry without a permit. HOWEVER, for anyone who plans to drink at a bar afterward, I would advise not carrying a firearm (with or without a permit).
Does a glove box not count?
Or a truck's toolbox?
Would aviators and black baseball cap violate mask laws?
Nope, you're good 👌🏻
VA statute indicates a "sealed container" within a vehicle for lawful concealment. According to one state lawmaker I've conversed with (when the statute was being updated in 2010), a plastic ziploc bag qualifies as a sealed container. <:richard:321796916218167301>
you can conceal a handgun in your glovebox yes. I do it every day.
With out permitting that is
Check the links I posted near the top.
According to VA § 18.2-422, helmets are ok. Perhaps even gladiator-type ones, as long as they don't cover significant portions of the face.
1300's optics are in effect. Second amendment is irrelevant
Random Reminder: Cops of all races are our natural allies; we should keep it that way.
The optics of black southern cops gassing antifa is perfect.
That's if you want cucks to think blacks have a place in our society
Virginia's self-defense laws
Nice. So it appears that if Antifa is acting overtly aggressive and you feel there is a threat of imminent unlawful touching or harm you can drop that faggot with a swift combo.
I thought it prudent to ask. What kind of legal defense do we have on our side for if but more likely when antifa and the leftwing establishment in cville tries to fuck us
@Furor_Tuetonicus we have Kyle Bristow. I believe we also have a couple other alt-right lawyers.
Any for Virginia though
afaik Kyle does not have the license to practice law in VA.
All I know if for Michigan and ohio
VA Body Armor Laws: § 18.2-287.2. Wearing of body armor while committing a crime; penalty. Any person who, while committing a crime of violence or a felony violation, has in his possession a firearm or knife and is wearing body armor designed to diminish the effect of the impact of a bullet or projectile, shall be guilty of a Class 4 felony. "Crime of violence" applies to and includes any of the following crimes or an attempt to commit any of the same, namely, murder, manslaughter, kidnapping, rape, mayhem, assault with intent to maim, disable, disfigure or kill, robbery, burglary, housebreaking, breaking and entering and larceny.
So basically body armor + defense ok?
It's overrated anyway our here no one is going to do shit.
I make homemade torches with lengths of aluminum tubing. Does anyone know if it would be illegal to carry those in the rally and/or if it's legal to wield it in self-defense?
What are the va laws on self defense? Of course we aren't going to start anything but at what point is it okay to react to the left's assaults
If you reasonably fear death (gun pointed at you) or have been seriously harmed or injured, you are legally allowed to defend yourself by all means. Keep in mind that this will be a huge event and that it won't be as easy to make a case
Also, VA is a stand your ground state
Virginia is a stand your ground state .
Virginia is a stand your ground state
Thanks to whoever deleted that. Not your fault, Virginia can be weird with some laws
@Aaron - VA
Thanks when did that get changed? When I got my VA CCW a few years ago they told us that VA wasn't.
Your article was mostly correct though. You more than likely can't just have a gun waved at you and you can then blast them away. But if you were violently beaten , or were shot at , you have the right to defend yourself by all means. Depends how much of a jew your lawyer is
USCCA offers self defense insurance, buy it
Is it legal to carry a club openly? Like a police baton?
Don't carry anything that's explicitly a weapon. Flag poles and signs work, but openly carrying obvious weaponry is probably not a good idea. @Spaceman (DSB)
Waving a gun at you is criminal menacing/brandishing (note that there's a difference between open carry and brandishing). Should be okay to defend yourself in that situation
36" rattan flag poles okay?
Not that I think any of us are felons, but:
It is **illegal** for felons in Virginia to concealed carry stun guns **except** within their own homes or after having their rights restored by a judge.
This question doesn't pertain to Virginia specifically, but I've heard there are state laws which were created back in the Cold War to protect leftists from getting fired simply for their political affiliations. I'm wondering which states have these laws in case many of us get doxxed at this event.
It's federal statute that prohibits discrimination based on political beliefs.
-in the workplace
The Civil Service Reform Act of 1978 (CSRA)
Now of course that specifically applies to gov't jobs, but almost every state had adopted it to apply to private sector, too. EEOC would know which states don't. Can look there
Anybody know if it's legal to open carry a baton? It looks like it's illegal to cc it
I believe it is legal. Spring-loaded baton is illegal
Gravity is good tho?
@junker many many goys are carrying guns, I see no problem with carrying a billyclub, my question wasn't of optics its of legality
Conceal carry is way different than walking into a crowd with a club, as far as optics go.
Is bear mace acceptable defence in VA law?
I wouldn't use bear mace, get standard OC spray. I personally use Fox Labs.
@Vice Commander Hunt To answer your question regarding batons; Carrying spring-loaded baton is illegal, but other batons are legal. But those batons that are legal I recommend that you open carry them as Virginia law is very vague regarding concealed carry of a baton.
Its best to avoid batons in my opinion, I would just get hardwood dowel (that fits in your hand) from a store and cut it to size.
For a flagpole
32-36 inches is optimal flagpole soze
anyoene know if burning antifa flags/LGBT pride flags/etc would be legal? or would they get you for arson on a public land
my guess is theyd stop it
You'd get in trouble
Open fires are illegal in Charlottesville http://www.virginia.edu/fsl/documents/Open%20Flame%20Guidelines%20(city%20code).pdf @doglad
@doglad flag burning is taking place after the rally. Don't do it at the rally you'll get arrested
anyone know if these are illegal?
I have no idea what the fuck I'm looking at?
Sap/Billy club il
I'll have to come back to that later, I am not sure about that.
That leather handle thing has a metal or lead weight in it. called a blackjack. And ya, popo definitely considers them an offensive weapon
they're pretty much the same thing as a bike lock on a rope/bandana/etc. highly dangerous
Saps are usually super illegal, even if not they show you're there for trouble
@here friend is asking if face paint is legal
It's not and it's not a good idea either.
Is it legal to run over protestors blocking roadways?
I'm NOT just shitposting. I would like clarification. I know it's legal in NC and a few other states. I'm legitimately curious for the answer
@Spaceman (DSB) face paint is not legal. A man got arrested and charged with a felony in Virginia because he was wearing face paint, and they considered that "a mask".
If someone were to call in a bomb threat at the last minute, what would be the police's procedure under Virginia state law?
To screw us over. Unless the police had searched and cleared the area at which point they could say the threat is without merit.
What would you guess they would bet they will do?
I figured. Just wanted to double check. :/ What's the likelihood of an enemy doing that?
Depends on if the think federal terrorism charges would be filed.
That tactic has largely died down since those sorts of laws have been passed
They used bomb threats against Milo last year. I could see them at least considering that option to shut us down, especially since this rally will be so big.
Tfw I hate hecklers veto so much that I go anyway and it's actually more than a threat because they failed to mention it wasn't a threat from antifa but actually the local mosque
Pretty shocked blackjacks aren't kosher.
lmao they're generally an offense-only weapon. Of course they wouldn't be allowed.
They scream "I'm here to hurt people and I don't care who"
A wrench with a wrist lanyard gets the same job accomplished.
At best it would simply delay the rally. It's not that big of a park to run dogs through
No-mask laws should be unconstitutional
I checked the va law and you can't even wear a gas mask
@Tiwaz in this scenario, it will actually help us. Also, the irony of it originally being intended to stifle KKK activity, but now being used to arrest those who oppose White Nationalism is pretty delicious.
Respirators should not be illegal
See (ii), since they are protective equipment and the intent is not to hide identity...
If you are in a situation where you are being maced why Not?
Can't wear it while randomly walking down the street
If you're actively Being maced you're not gonna have time to put that on
And that's a sure way to get charged
I'm bringing a 3m half mask respirator
@Johnny O'Malley I'm not worried about mace, i've been maced in the face before. CS gas is much much worse
I'd take cs gas over mace 7 days a week
@Johnny O'Malley Haha really? A pair of sunglasses will mitigate most of the debilitating effects of pepper spray, but not a nice thick cloud of CS
Yeah but as soon as you get away from the cs and clap your arms a little you're fine. Great for allergies and sinuses. Last time I Personally got maced I was down for about 15- 20 mins
Yeah it sure is good for your sinuses alright, will clear them right out 😄
Pepper spray is probably more likely to be deployed at this event than cs gas though, i'm willing to guess
Is there any law restricting the type of flag poles we bring? Im willing to look up statutes but no idea what sort of statute would restrict this
@WhiteTrash I haven't seen it mentioned. Are you wanting to bring something weird?
was just gonna get a dowel rod or something
or buy a flagpole off amazon..whatever
That part in the law about protective devices is for people who are actively employed in a business that requires them to use protective gear
Not just anyone wearing protective gear
Nathan is checking with the police on flagpoles because there was some concerns over them being construed as weapons. He is supposed to make an announcement about it as soon as he finds out something
Kkk had flag poles no?
I believe so. On live hours last night he said that the police were going to try and control the group's getting into the park and the flag post may not be allowed but they are going to follow up
i'm gonna be there early before they control so whatever
only real question is AK47 or AR15
i kid i don'te ven have any funs
but i do have lots of flags
@greg-ky VA is not CA or DC. The police cannot under pretty much any circumstances prevent you from carrying anything that is not explictly illegal by state law. You can open carry a sword if you want, as long as you do not brandish it. Nathan doesn't understand how the law works here, which is why he said that.
Thats very bad advice
Stop giving bad legal advice unless you're a lawyer
You literally cut out the part for how it's about wearing respirators and masks in the process of working a job
"engaged in professions, trades, employment or other activities and wearing protective masks which are deemed necessary for the physical safety of the wearer"
"or other activities and wearing protective masks which are deemed necessary for the physical safety of the wearer" means the law covers it. if antifa or cops are slinging pepper spray is that not deemed necessary for your physical safety?
Are you a lawyer?
no its called reading comprehension
"It shall be unlawful for any person over 16 years of age to, with the intent to conceal his identity," this part also nullifies wearing a respirator and sunglasses being a crime since your intent is for personal protection from chemical agents and not to conceal your identity
Is this also the section where we give bad lifting advice?
Intent seems to be a key word there
And what is the definition of "other activities"?
I do know a Virginia lawyer... I'll inquire
@Melektaus that is horrible advice. If you wear any kind of face covering material (except sunglasses) you will be arrested and charged with a felony
Most riot police will not stop to hear your "comprehension" of the law as they arrest you
@SaintCharles Its best to let people do as they wish, if they don't follow laws , thats on them. I've tried helping but people insist to resist the advice
I'm clear on the VA provisions for open carry from the above. Thank you!
That said, do we anticipate any part of the public event(s) taking place in one of the numerous localities/settings to which specific prohibitions apply? Do we have men who plan to open carry?
I'm seriously contemplating a full-size pistol in a drop-leg platform.
@PureDureSure no place we will be will prohibit carry. However open carry is highly frowned upon
Thank you, @Kurt . I may have to forego carrying a gun, then. I don't have an active CWP of any description/jurisdiction.
so get one.
I'm going to try, but doubt they'll turn the application around in less than two weeks' time (they claim a 90-day potential maximum).
depends on the state
Depends on the county
Not that they would ever have reason to so much as know where we're lodging, but on the 0.1% chance they were to take some interest in it, would VA law look with disdain on the presence of some hardware in the house in which we're bedding down?
VA is a fire arm friendly state... hell it is an open carry state
I got mine back in a week so I would try and see what happens
I dunno it doesn't take a $200/hr lawyer to read and understand one sentence but that's just me. I doubt anyone will be tackled to the ground and cuffed because you pulled out and donned a respirator if antifa started spewing pepper spray.
It all depends on the state and the town, in RI it can take from 2 weeks for some of the town permits to over 6mo for CCW from the attorney general then states like NJ or NY can take years
Take it for what it's worth, but LEO's arrested a bunch of Antifa for masking up after tear gas was deployed.
At the Klan rally recently.
"We tried to gas you but you tried to protect yourself from it now you're under arrest"
Law and law enforcement doesn't always make sense, but it is what it is.
They're going to remember who wears any kind of mask and will arrest you the first chance they get.
I concede. I forget police aren't on our side. Yet.
Most of them are in Philly lol
Well the face paint joker was a special case, it was some guy dressed up as the joker in carrying around a sword which is legal to carry a sword but they wanted to arrest him and used that as an excuse.
so it means what they want it to mean
When they have political demonstations happening with two aggravated sides, they WILL arrest you for covering your face
@here so what is the conclusion on open carry? I want a sound and solid take on it.
What I mean is, who here has talked to the Cville police about our options for open carry because the 3%ers are always at these things with their guns out right?
Check pinned messages. I believe that all the information you need is there.
Nope, read through the pins again @crockett and I am seeing nothing like what I asked. It seems that if they really want to they can nail you hard if you are carrying and say you get in a fight, my question is 'what is the current state/mood of the police in this?' because a LOT rides on that.
I guess another way of putting it is this:
Antifa are going to be the ones starting shit, we already know this, do the cops know this?
If I have to smash an antifa in the face for coming at me with a pole, are the cops going to be assholes about the gun I have on my belt?
I haven't spoken to anyone in the PD. I can't answer who they think will start the violence.
Okay I think we need to find out
Are you thinking that having a gun on you while you get into a fight will bring extra charges?
It says as much in the pins
Enacting a "felony" while possessing a gun can bring extra charges
So it all depends upon the police
Worst case scenario
Depending upon the situation they will be stricter or more lenient, this is just the nature of reality and policing
Their political slant matters, the political slant of the chief of police matters too
Pressure from the public one way or another also comes into play
Police are just guys trying to do a job and keep the peace
But they WILL take sides, the job kinda requires it
They can charge you with whatever they want. You'll just have to fight it out with the prosecutor or a judge if it makes it to trial.
They have a new chief
He's a Wes Bellamy pick.
VSP were the main LEO's for the klan rally
Read AARs from that
Wes Bellamy NIGGER
You think it will be VSP this time?
CPD is too small for this
VSP will be focused on antifa not us
Especially if we kiss some ass with a few blue lives matter chants
VSP, County, City, & Homeland Security police will be there.
Be nice to cops and they will be nice to you
Can we get in contact with WH?
That's not always the case but most of the time yes
I'm simply trying to get a feel for the police and leaders that will be organizing this
