@William Russell actually no, sometimes in negligence claims losses happen and nobody is to blame and the loss must unfortunately remain upon the plaintiff because nobody is a substantial factor. In order to shift the loss from the victim/plaintiff to a defendant they must be held liable via duty, breach, causation (actual and proximate) and damages. The police are arguably liable for negligence if not outright reckless behavior since they knowingly disregarded a substantial risk. I would say that the government of cville even acted purposefully.
