Hi everyone.

2020-11-20 17:49:58 UTC [RobertGrulerEsq #general-chat]

Totally new to the chat. But been watching the videos for a while.

@osok if itโ€™s SCOTUS, and a Justice decided to recuse, the Court would have to sit with less than a full panel.

Anyone following the king v whitmer case?

2020-12-06 20:35:52 UTC [RobertGrulerEsq #election2020]

No itโ€™s the Powell Michigan case. Judge decided no oral argument on plaintiffsโ€™ TRO

Rudy now has Covid

The flue vaccine under Obama admin - those companies paid out $$$

No thank you for sharing. Thoughts?

My issue is with the PA Supreme Court applying laches. Itโ€™s an easy way out. Itโ€™s unconstitutional and not sure if it was even ripe until after the election.

2020-12-06 21:26:01 UTC [RobertGrulerEsq #election2020]

No this is the case brought by congressman Kelly from Pa. lost on laches in PA SC and is asking SCOTUS to hear it. The case you are referring to is also still pending.

2020-12-06 21:35:57 UTC [RobertGrulerEsq #election2020]

Itโ€™s still pending. Thereโ€™s now two cases in front of SCOTUS on PA issues.

2020-12-06 21:36:27 UTC [RobertGrulerEsq #election2020]

Only if you trust their count of 10k

2020-12-06 21:39:40 UTC [RobertGrulerEsq #election2020]

Thatโ€™s your opinion. SCOTUS hasnโ€™t ruled either way. Their certification means nothing.

2020-12-06 21:46:14 UTC [RobertGrulerEsq #election2020]

Not denying certification but if they throw votes out due to it being unconstitutional, they could remand it back to count the legal votes which could change the outcome of certifying the winner.

2020-12-06 21:48:28 UTC [RobertGrulerEsq #election2020]

77 is definitely different for sure. Will be interesting if SCOTUS grants review of a state constitution arguably tied to the federal constitution.

2020-12-06 21:52:57 UTC [RobertGrulerEsq #election2020]

Unless you are messing with a federal law

2020-12-06 21:55:00 UTC [RobertGrulerEsq #election2020]

My opinion, it is against federal law when crossing state lines. Feds just wonโ€™t jump in on it.

2020-12-06 21:56:20 UTC [RobertGrulerEsq #election2020]

Thatโ€™s a problem

2020-12-06 21:56:48 UTC [RobertGrulerEsq #election2020]

Interstate versus intrastate

2020-12-06 21:57:07 UTC [RobertGrulerEsq #election2020]

What about military?

2020-12-06 21:58:48 UTC [RobertGrulerEsq #election2020]

One could argue using the mail in general is also a federal issue.

2020-12-06 21:59:27 UTC [RobertGrulerEsq #election2020]

I would say yes.

2020-12-06 22:01:53 UTC [RobertGrulerEsq #election2020]

There are a bunch of states that filed amicus briefs in the pre election PA case. Canโ€™t just change something because you want to.

2020-12-06 22:30:38 UTC [RobertGrulerEsq #election2020]

Justice Alito even said โ€œIt would be highly desirable to issue a ruling on the con- stitutionality of the State Supreme Courtโ€™s decision before the election. That question has national importance, and there is a strong likelihood that the State Supreme Court decision violates the Federal Constitution. The provisions of the Federal Constitution conferring on state legislatures, not state courts, the authority to make rules governing fed- eral elections would be meaningless if a state court could override the rules adopted by the legislature simply by claiming that a state constitutional provision gave the courts the authority to make whatever rules it thought ap- propriate for the conduct of a fair electionโ€

2020-12-06 22:40:28 UTC [RobertGrulerEsq #election2020]

Yea Iโ€™m familiar with both cases and the different issues.

https://www.supremecourt.gov/opinions/20pdf/20-542_i3dj.pdf

That might help you on 77 with regards to the original issue in front of SCOTUS.

The other 77 issue for this Tuesday is https://www.supremecourt.gov/DocketPDF/20/20A98/162573/20201203162739451_Final_Emergency%20Application%20for%20Writ%20of%20Injunction.pdf

I know itโ€™s been shared but in case you missed it

2020-12-06 22:49:54 UTC [RobertGrulerEsq #election2020]

Not yet. Response is due Tuesday

2020-12-13 23:31:28 UTC [RobertGrulerEsq #scotus]

@SoonMrWick did you find a decision by Wisconsin Supreme Court? I watched the hearing live but havenโ€™t seen a decision.
