In Griggs v. Duke Power Company The Supreme Court decided in 1971 that requiring job applicants to take IQ tests (or any test that can't be shown to measure skill related to the job) violated Title VII of the 1964 Civil Rights Act.

@ophiuchus I can actually respond to this, having gone to college in Washington, where affirmative action is illegal
I personally got in through affirmative action, because it will see facto exists
What they do is they ask essay questions that you can only reasonably answer if you're a minority
For example, they'll have a carefully worded question about diversity and cultural differences and the like

I'd probably write it on men in my family being union men engaged in class struggle and they'd eat it up despite them being old Anglo American through and through
I don't remember what the question was, but it was intentionally worded to make it very difficult for real Americans to answer
@Ald they dont di "iq tests" they do "aptitude" tests where theyll ask you questions that requires logic skills.

An English class of mine in hs had a project of this kind, on our great diversity and what those in our roots had to overcome to become American. This was in a mostly Asian Jewish and brown class
And I not even being fully woke at the time wrote about my ancestors having to fight the Indians and such
Cause it was like I'm white what am I supposed to say
We weren't outsiders who had to worm our way in
