you mean there is a jury of my peers i would like to meet them... wow you would not want to walk into our land just saying

2021-01-01 14:00:46 UTC

As a jury member, you would be required to determine whether or not a person was guilty *as defined by what the law says*. Otherwise you're not doing your duty as a jury member.

2021-01-01 14:01:29 UTC

If you don't agree with the law, you're removed from the jury usually.

2021-01-01 14:01:41 UTC

Exactly. I cannot convict someone unless they have broken the law. Period. I do not have to convict.

2021-01-01 14:01:56 UTC

DAM YOU KIDS GET OFF MY LAWN!

2021-01-01 14:02:17 UTC

Tell dc juries that

2021-01-01 14:02:18 UTC

You have to determine guilt or innocence. Probably technically it's the judge that then convicts.

2021-01-01 14:02:18 UTC

@Philip R, you just advanced to level 7!

2021-01-01 14:02:44 UTC

Is there any clarification about the super odd claims they hacked a GA voting machine

2021-01-01 14:02:59 UTC

What? No, not how it works. If it's trial by jury, it's judgment by jury.

2021-01-01 14:03:08 UTC

Hence why it's called trial by jury.

2021-01-01 14:03:09 UTC

Wrong! I determine if they are guilty or not guilty.

2021-01-01 14:03:41 UTC

Also interested in this!

@Dedkraken Robbed a bank to show it's possible under unnaturally contrived circumstances, I reckon.

2021-01-01 14:04:34 UTC

He explained it poorly in technical and layman’s terms

2021-01-01 14:04:41 UTC

Juries are allowed to produce unlawful outcomes in America.

2021-01-01 14:04:59 UTC

Not sure what you mean by judgement by jury. Juries in Texas also sentence. Not so in federal and most other states.

2021-01-01 14:05:04 UTC

Okay, I did say "probably". As for "trial by jury", that doesn't mean that the jury handles the entire process; the judge is the one that passes sentence, at least.

2021-01-01 14:05:27 UTC

> He explained it poorly in technical and layman’s terms
@Dedkraken That's what charlatans *do*. I don't understand your confusion. It seems very plain.

2021-01-01 14:05:27 UTC

Well, except perhaps for Texas!

2021-01-01 14:05:29 UTC

He's saying judges can overrule juries, Greg.

2021-01-01 14:05:32 UTC

umm i claim the chewbacca defense!

2021-01-01 14:05:53 UTC

Hahaha Chewbacca defense.

2021-01-01 14:05:58 UTC

no

2021-01-01 14:06:21 UTC

State-specific, but rulings are handled by juries, not judges, in trial by jury.

2021-01-01 14:06:27 UTC

They can overrule a jury and find someone not guilty. They cannot overrule a jury and find someone guilty.

2021-01-01 14:07:15 UTC

Is Trump Chewbacca

2021-01-01 14:07:50 UTC

From https://www.nolo.com/legal-encyclopedia/criminal-sentencing-faq.html: "Judges, not juries, almost always determine the punishment, even following jury trials. In fact, a common jury instruction warns jurors not to consider the question of punishment when deciding a defendant's guilt or innocence."

2021-01-01 14:07:53 UTC

The courts must be biased if they don’t let the wookie win

2021-01-01 14:08:09 UTC

Also in Texas, the defendant can choose judge or jury for sentencing.

2021-01-01 14:08:23 UTC

No one doesn't like wookies.

2021-01-01 14:08:30 UTC

Emperors maybe.

2021-01-01 14:08:40 UTC

But not in Texas!

2021-01-01 14:09:16 UTC

That would be why it said "almost always".

2021-01-01 14:09:24 UTC

That’s not what the Chewbacca defense is? Shame on you South Park

2021-01-01 14:10:17 UTC

You're pivoting to sentencing when we were talking about verdict.

2021-01-01 14:10:47 UTC

They're related.

2021-01-01 14:11:16 UTC

In fact, when I Googled "do juries pass sentence ", one of the options that came up was "do juries pass sentence in Texas"!

2021-01-01 14:12:04 UTC

I don't think anyone would dispute that Texas is 'special'.

2021-01-01 14:12:10 UTC

Verdict != sentencing.

2021-01-01 14:12:28 UTC

GOD BLESS TEXAS!
