Well, except perhaps for Texas!
He's saying judges can overrule juries, Greg.
umm i claim the chewbacca defense!
Hahaha Chewbacca defense.
no
State-specific, but rulings are handled by juries, not judges, in trial by jury.
They can overrule a jury and find someone not guilty. They cannot overrule a jury and find someone guilty.
Is Trump Chewbacca
From https://www.nolo.com/legal-encyclopedia/criminal-sentencing-faq.html: "Judges, not juries, almost always determine the punishment, even following jury trials. In fact, a common jury instruction warns jurors not to consider the question of punishment when deciding a defendant's guilt or innocence."
The courts must be biased if they don’t let the wookie win
Also in Texas, the defendant can choose judge or jury for sentencing.
No one doesn't like wookies.
Emperors maybe.
But not in Texas!
That would be why it said "almost always".
That’s not what the Chewbacca defense is? Shame on you South Park
You're pivoting to sentencing when we were talking about verdict.
They're related.
In fact, when I Googled "do juries pass sentence ", one of the options that came up was "do juries pass sentence in Texas"!
I don't think anyone would dispute that Texas is 'special'.
GOD BLESS TEXAS!
Amen
I said that trial by jury doesn't mean that the jury does everything; judges still pass sentence. And therefore "trial by jury" doesn't *necessarily* mean that juries convict as opposed to just determining guilt or otherwise.
Ok, but that wasn't my argument.
your Honer i am sorry but that codom is much to large for me. "if the glove does not fit you must acquit" so "i did not have sexual relations with that woman" = chewbacca!
Also being convicted is the determination of guilt.
LOL!!!
Hence why it's "being convicted and sentenced"
sorry all i never claimed i was right but 90% of my arguments hold up in court
That's the bit that I wasn't sure of (and did not dogmatically claim). But I've now checked, and you're correct; determination of guilt IS the conviction.
I've never been a juror on a criminal trial; they don't want me.
I was on one once, but the trial was aborted.
yea i dodged a coat hanger for the 1st 9 mounths of my life...
Really? Hard to dodge; there wasn't much room was there?
It wasn't murder, it was a 4th trimester abortion.
when you are backed against a wall you will be surprised what most can do
There were walls?
just wondering when is it to late to abort my son is 30 now what does the Scotus say?
Bad territory. My brother died at birth in "60. I was 1. The marriage went south after that.
yea no answer must be a latches thing
