although only against the larger corporate media

2019-01-21 16:17:23 UTC

though that's more common in personal injury law

2019-01-21 16:17:27 UTC

not the individuals on twitter

2019-01-21 16:17:43 UTC

well, for the class action

2019-01-21 16:20:12 UTC

Thanks for the addition grenade. But idk it all depends if the kid gets assaulted. That is if he does. Hopefully he doesnt.

2019-01-21 16:20:33 UTC

Libel and slander does not require assault

2019-01-21 16:24:39 UTC

there is a video of evidence refuting the claims. If they do not publicly issue a retract of their stories, there might be a strong case of them knowingly spreading lies with intent to damage or harm. And that easy to prove with screenshots of people's reactions on twitter. It goes basically like this: You claim A, video refutes A and proves B, people react violently to A, you now refuse to publicly retract A despite it causing violent reactions and being proven wrong. Therefore you are knowingly spreading lies with the result of attempted harm.

Well i understand but wouldnt he also have to sue twitter for enaging in such acts of threatening?

unfortunately no. This is an issue caused by section 230, the like only surviving section of the Communications Decency Act. It protects them as if they are a platform, rather than a publisher. A newspaper and book publisher are responsible for what they allow to be published, even if they don't write it. a Platform is not. This was originally to allow online platforms to censor foul language while not being held responsibly as if they were a publisher, despite them acting like an editor like a publisher does.

2019-01-21 16:29:11 UTC

this is what allows them to censor people and then prevent you from suing them

2019-01-21 16:30:34 UTC

they can sue the individual who writes these tweets, or press possible criminal charges for threats. Actually, i believe assault is verbal, these people might be guilty of assault. Rather than battery which is the hands on part. but i feel that might be hard to win.

2019-01-21 16:31:07 UTC

Assault is both physical and verbal

2019-01-21 16:31:49 UTC

Depending on how the verbal part is addressed. In this case it is.. Since ppl do want to harm him or express the kid into getting harm.

2019-01-21 16:31:50 UTC

assault is threats of violence, battery is the violence itself

2019-01-21 16:31:55 UTC

^

2019-01-21 16:32:05 UTC

but colloquially speaking, assault is the violence

2019-01-21 16:32:19 UTC

it's only legally that there's a distinction really

2019-01-21 16:32:26 UTC

yes.

2019-01-21 16:32:46 UTC

this is why people get charged with assault AND battery

2019-01-21 16:32:51 UTC

rather than everything just being assault

2019-01-21 16:33:09 UTC

in common parlance, there's "threats of violence" and "assault," which legally are respectively assault and battery

2019-01-21 16:33:16 UTC

though in many states, that's not the case either

2019-01-21 16:33:26 UTC

it's different everywhere

2019-01-21 16:33:36 UTC

things always get weird once you get down to the state

2019-01-21 16:33:40 UTC

or past the state to local

2019-01-21 16:33:42 UTC

some states have "communicating threats" and "assault"

2019-01-21 16:34:01 UTC

you'll get something weird like "its only assault if its not on Sunday"

2019-01-21 16:36:04 UTC

the new flag will be 13 stripes for the original colonies and 2 stars

2019-01-21 16:36:09 UTC

1 star for the 49 states

2019-01-21 16:36:13 UTC

and the other for New Jersey

2019-01-21 16:36:17 UTC

😎

2019-01-21 16:36:22 UTC

2019-01-21 16:38:49 UTC

i wonder how bad twitter is today or if it has calmed any

2019-01-21 16:39:21 UTC

Still pretty bad in some places. Some people seem to be doubling down or trying to argue from a different angle.

2019-01-21 16:39:56 UTC

^

2019-01-21 16:40:05 UTC

what angle now?

2019-01-21 16:40:29 UTC

Why i dont want to have twitter. Have been seeing how crazy they are when they confront Tim, EVS, Ya boi zack or some other ppl.

2019-01-21 16:40:55 UTC

yeah i avoid twitter for that reason^
