yeah it's a lot to keep in mind, and i'm sorry for the interrogation and all the questions, your situation is just very complex it seems and gripping to me

2019-01-18 18:52:55 UTC

i really feel for you, i'll be sure to send my prayers and thoughts to you every day

2019-01-18 18:53:31 UTC

I'd offer to help financially but I'm no Rockefeller lol

2019-01-18 18:57:48 UTC

Trust me, I know the feeling. It's amazing that kids' lives in the balance, it's not about right/wrong/justice...too much is determined by money

2019-01-18 18:58:26 UTC

yep money talks unfortunately

2019-01-18 18:58:46 UTC

cruel reality of this world, no matter how good you are

2019-01-19 02:08:05 UTC

Question for ga people. My wife constantly call my job lying about things. Its starting to get annoying is there anything i can do

2019-01-19 02:09:03 UTC

Are you separated?

2019-01-19 02:09:07 UTC

What kind of things?

2019-01-19 02:20:06 UTC

If you're going through a divorce you should tell your lawyer. They may be able to file paperwork against her like a harassment order

2019-01-19 02:20:11 UTC
2019-01-19 02:25:18 UTC

ok i will let my lawyer know

2019-01-19 03:18:22 UTC

Yeah, you can do things about that for sure. It is actually likely a good sign.

2019-01-19 03:27:42 UTC

Men get the shaft :(

2019-01-19 11:56:10 UTC

@Night Terror if you have a supervisor you trust with details, check to see if anything can be recorded with your work. Maybe check in with HR.

2019-01-19 11:56:56 UTC

In GA, if one party consents to a recording (you in this instance) then it can count as evidence. That doesn't save you from getting in trouble at work for breaking their rules, though

2019-01-19 11:58:12 UTC

If it's cool to record with work, get her to say stuff to use against her. Be like, "didn't you come here last week? Didn't you ask the same stuff? I know I told you I didn't want you coming around here!"

2019-01-19 14:18:25 UTC

@Night Terror I don't knownabiut your area, but innminen you can get a civil stay away order. Bascically ardernthstnsaysnyou two have to stay away / not harrassneacjother under penalty if contempt of court.

2019-01-19 14:19:01 UTC

Damn man is your space bar stuck

2019-01-19 14:20:25 UTC

Well she lives in Florida and to record her she would have to agree.

2019-01-19 14:20:56 UTC

And im in the army so there that

2019-01-19 14:58:31 UTC

Oh hell dude get your JAG involved. They aren't likely to put up with her sugar honey ice tea

2019-01-19 14:59:21 UTC

Document what you can, but she best not be causin a ruckus on base or MPs will take her right to holding

2019-01-22 17:07:09 UTC

So i was rereading the "list" and a lot of it is valuable but some of it seems a bit extreme and not something i want to get into personally. of course, they say tailor it to your needs. but i'm interested in anyone's else take on the "list" which also was started in 2005 - so are a lot of the "rules" still relevant today?

2019-01-22 17:14:41 UTC

@Dan da Dad hey i had a question regarding recordings because i plan on using some recorded convos with my stbx - i live in a one party consent state. can her attorney ask for all of the recordings or will i be able to offer only recordings that i deem applicable as evidence?

2019-01-22 18:55:54 UTC

During Discovery, all applicable recordings will be disclosed. If they ask for others, you must be truthful. If you fail to disclose, it may bit be admissible later (except as rebuttal). Take care to catalog them well

2019-01-22 18:56:06 UTC

Case had been bumped up to superior court, and the Public Defenders Office needs a week to process the change. Nothing will happen today. I'm done at the court house and headed home.

2019-01-23 01:44:33 UTC

Oof... So it was a wasted trip?

2019-01-23 16:15:25 UTC

I've had so many wasted trips to the courthouse and parking is a pain to say the least. I'd get their and stbx would ask for continuance. I'd be so pissed off.

2019-01-23 16:15:58 UTC

screw this legal system is broken

2019-01-23 17:29:06 UTC

@Dan da Dad i have a ip camera that is continuously recording and its got endless recordings, too much to go thru. i have some important days that are applicable but i have a ton of extra footage which i cant remember if there was anything but i haven't done anything wrong to the stbx but there might be footage of us smoking weed which i'd rather not share lol. still illegal in my state

2019-01-23 18:59:34 UTC

Legal system is broken but you gotta play the game.

2019-01-23 19:00:23 UTC

Its all a game

2019-01-23 23:37:04 UTC

That's why we gotta learn to play by the rules. She most likely also doesn't want that footage shown. Catalog what you claim are applicable times to submit as evidence and crop that part. Don't delete the rest yet. I would also catalog other conversations. If she recalls a discussion that you can't present, she could claim there are other conversations y'all had that never took place and you are putting forth what's convenient. It's weak, but little things add up. If you can go, "on the time and date you alleged, I have this recording." Adds validity to your recordings, even if some are against you - they can't be denied as a whole.

2019-01-23 23:39:29 UTC

As for my case, I showed up, stated my application is under review for a Public Defender. I was told I would be contacted by them and could leave for the day.

2019-01-23 23:42:56 UTC

They called me today, and told me the DA has no plans to drop the case at this time. There is no lesser included charge to plead down. We can ask for a pretrial diversion (he explained it's like a year of probation that would get wiped after, and does not count as a conviction) because I have no record. I asked how that could be used against me in the divorce hearing, and he's looking into it, and will call me about it later, possibly tomorrow.

2019-01-23 23:44:46 UTC

I told him my attitude is that it would be difficult for a jury to want to convict a man who recorded in his own home who had nothing to gain, and to grant an adultress any benefit, and I would be ready to fight it, especially if it could be used in the divorce hearing.

2019-01-24 14:01:50 UTC

@ChitwnRogue Start going through it! You should keep a log if anything new happens and make a compilation of the stuff. You can fast forward through most of it.

2019-01-24 23:36:22 UTC

Ok, thanks. Any reason why I shouldn't delete older irrelevant footage? Can the court come to my house and confiscate all my recordings? I think most of the older footage has already been recorded over since the camera deletes older footage to make room for new. Also, it's in a format that makes it difficult to go through, what a pain.

2019-01-25 09:57:45 UTC

Ah, that's a pain. It would have been good to save all the footage from days when she was acting out or being abusive.

2019-01-25 09:58:27 UTC

As a general rule, if you edit footage it can be thrown out - but I hope you have saved a few examples at least.
