So i was rereading the "list" and a lot of it is valuable but some of it seems a bit extreme and not something i want to get into personally. of course, they say tailor it to your needs. but i'm interested in anyone's else take on the "list" which also was started in 2005 - so are a lot of the "rules" still relevant today?
@Dan da Dad hey i had a question regarding recordings because i plan on using some recorded convos with my stbx - i live in a one party consent state. can her attorney ask for all of the recordings or will i be able to offer only recordings that i deem applicable as evidence?
During Discovery, all applicable recordings will be disclosed. If they ask for others, you must be truthful. If you fail to disclose, it may bit be admissible later (except as rebuttal). Take care to catalog them well
Case had been bumped up to superior court, and the Public Defenders Office needs a week to process the change. Nothing will happen today. I'm done at the court house and headed home.

I've had so many wasted trips to the courthouse and parking is a pain to say the least. I'd get their and stbx would ask for continuance. I'd be so pissed off.

@Dan da Dad i have a ip camera that is continuously recording and its got endless recordings, too much to go thru. i have some important days that are applicable but i have a ton of extra footage which i cant remember if there was anything but i haven't done anything wrong to the stbx but there might be footage of us smoking weed which i'd rather not share lol. still illegal in my state

That's why we gotta learn to play by the rules. She most likely also doesn't want that footage shown. Catalog what you claim are applicable times to submit as evidence and crop that part. Don't delete the rest yet. I would also catalog other conversations. If she recalls a discussion that you can't present, she could claim there are other conversations y'all had that never took place and you are putting forth what's convenient. It's weak, but little things add up. If you can go, "on the time and date you alleged, I have this recording." Adds validity to your recordings, even if some are against you - they can't be denied as a whole.
As for my case, I showed up, stated my application is under review for a Public Defender. I was told I would be contacted by them and could leave for the day.
They called me today, and told me the DA has no plans to drop the case at this time. There is no lesser included charge to plead down. We can ask for a pretrial diversion (he explained it's like a year of probation that would get wiped after, and does not count as a conviction) because I have no record. I asked how that could be used against me in the divorce hearing, and he's looking into it, and will call me about it later, possibly tomorrow.
I told him my attitude is that it would be difficult for a jury to want to convict a man who recorded in his own home who had nothing to gain, and to grant an adultress any benefit, and I would be ready to fight it, especially if it could be used in the divorce hearing.
@ChitwnRogue Start going through it! You should keep a log if anything new happens and make a compilation of the stuff. You can fast forward through most of it.
Ok, thanks. Any reason why I shouldn't delete older irrelevant footage? Can the court come to my house and confiscate all my recordings? I think most of the older footage has already been recorded over since the camera deletes older footage to make room for new. Also, it's in a format that makes it difficult to go through, what a pain.
Ah, that's a pain. It would have been good to save all the footage from days when she was acting out or being abusive.
As a general rule, if you edit footage it can be thrown out - but I hope you have saved a few examples at least.
So i'm pretty new to this scene. But I'm seeing the injustices against men especially in family court. I admit I only became aware once it started kicking my ass and became personal. Are there any petitiions i can sign to help men's rights?
I'd like to contribute as much as I can but my time is limited with this divorce , mostly filling out affidavits and other paperwork.

@Men Are Human thanks for the advice, i have so much evidence already on the stbx. I learned early on to record everything once she started making fake domestic violence calls to the police.

people are slowly but surely waking up to how common stuff like that is
ya anyone that visits my house will think i'm overly paranoid or creepy but gotta do to protect myself from crazy.

oh ya and during a free consult with an established attorney (40yrs experience) i mentioned how the family court system is biased v. men. and how there's a movement and documentaries. and he doesn't believe this bias doesn't exist and said it just sounds like a bunch of angry men who didn't get what they wanted in their divorces.

Hmm, divorce channel does not seem very popular. I can understand, such a horrible process, can't wait till it's all over. I got charged $50 just for an email exchange, fml
It's a support channel, so it's usually used to give support when people need it
