In order for the House to choose the President, the electoral college votes must be tied or neither candidate gaining enough electoral votes (270 to win). I has nothing to do with the concession of either candidate or courts resolving the issues. It has everything to do with the electoral college votes being a tie or lack of enough electoral votes for either candidate.

From Amendment 12 of the US Constitution:
"The person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice."

A tie in electoral college votes has happened once, in 1800.
However....there was an election in 1824 in which one candidate DID win the majority of the electoral vote and it still went through this process. This happened because of multiple candidates and a required electoral vote of 131 to win. Jackson had 99 electoral votes while all other candidates had less.
And...there was an election in 1876 in which Hayes received 185 electoral college votes to Tilden's 184 electoral collage votes....which was resolved by the Compromise of 1877.
