They appear to have gone to great lengths to make a distinction between Mail-in and Absentee in an effort to side-step the constitutional concerns. The very people who now want to call it unconstitutional - and who would be fighting to say that it is constitutional, if Trump had won.

An unconstitutional law is unconstitutional from its inception. That is a well established precedent. No procedural ploy such as lack of timeliness will negate those established precedents. The PA S. Ct failure to hear a case on those issues doesn’t change that law either.
