I disagree with you now. According to the 10th ammendment, unless it's already in the constitution, fuckyou, it has to be declared by the state now.
That's what this ruling says from a legal standpoint.
If the violation in question can be links to one of the amendments, it can still be addressed federally. The Constitution covers the states
