Cat and paradigm both just agreed with me :D;;; We're all on the same page about what is and isn't legal at this point, due to this ruling. We're just on opposing sides about wether we think it's right or not.
Thus due process doesn't apply.
Maybe Hillary Clinton is considered her own state and that is why it's okay for her to suicide people.
Oh, no, don't get me wrong. This is absolutely terrible.
But it is the law of the land as it stands.
regarding de-criminalized murder... I'd venture that a 14th amendment challenge would succeed in defeating such a state law
In any case, even good laws generally have downsides. Because we acknowledge a right to individually bear arms we see far more gun killings than other western countries.
Because we have a right to free speech, we have hate speech
Because we reserve rights to the states, you have inconsistent laws across the country
Now now @DrYuriMom , we shouldn't discount them entirely. They have so many more TRUCKS OF PEACE than we do though!
I don't think there is such a thing as hate speech.
@paradigm Not true, the feds havnt been able to smite down the assisted suicide law in Oregan
Actually, the Supreme Court just ruled on that.
Not to mention acid attacks
That is how our nation was designed
Its completely ok
mmm... assisted suicide is a good point
Hey, can I assist that judge who made this ruling in suiciding? I bet he really really wants to die.
Ask Killary.
Tbh I actually agree with assisted suicide
Ah, but assisted suicide violates the 14th amendment.
I mean they are gonna die anyway, its gonna be extremely painful, and all the doctor does is provide the pill
It only violates the 14th ammendment if the state assists in the suicide, if an individual does it, it's not a violation.
You still can choose not to take it
But the law which allows for assisted suicide is an abridgment of the individuals privilege to life, and thus enforcing it is a broach of the amendment.
I've watched some serious suffering. I won't participate with assisted suicide on personal moral grounds, but I support the right to it with proper safeguards to ensure it is not abused. And yes, this is a state issue.
Its not enforced, teh state does not require a doctor to provide the pill
Where in the constitution is there a requirement upon the individual that they remain alive?
14th ammendment doesn't give you any rights to life. It only prevents the state's right of taking it away, and ONLY if without due process. You can still murder the fuck out of anyone you want as long as it's had due process.
But the law allows the killing of an individual under specific circumstances, an exception to laws which protect the taking of lives without due process.
There are restrictions on the state's ability to take life, yes.
And to enforce laws which allow for the abridgement of citizen privileges.
technically speaking, the state can provide assisted suicide without violating the 14th, as long as due process is undergone before committing it.
but assisted suicide is literally just a doctor giving you a pill to kill yourself with
He can not force you to take it
Exactly
and the 14th doesn't say anything about non-state entities from doing it, at all
That is murder, in fact, the doctor can not be in the room at all
And good laws require multiple steps before the assistance can be provided.
> individuals privilege to life
life is a right
and protected against State action by the 14th
