I dont think either will stick but conspiracy doesnt crequire any explicit agreement, an implicit agreement is enough. A conspirator can be held legaly responsible for any crimes commited by a co-conspirator so long as the act falls in the scope of the conspiracy or is a forseeable consequence of it. Say, people physicly attack people based on SPLC information. This would of course require prove of mens rea which is very hard to impossible.
