when they did find out asbestos was bad for you, the did first remove the asbestos from only where they expected the teacher to be as that was demanded by the Working environment act but did ignore the rooms and hallways for the kids as they was not covered by the law, it did not change until the parents did find out and did make a huge stink about it. but even to day there is no law that states the general air quality for the kids in schools only for the teachers.
the end result is that you have changing rooms for kids that have black fungus and the teachers room is brand spanking new

Even if not unconstitutional per say, it does seem to violate discrimination laws, if not open for harrassment laws.
hard to say - these people have infested academia, and if the parents have to argue against the made up terms and definitions that are somehow accepted without a shred of evidence, it's going to be an uphill battle
but one that needs to be fought. I'd say this is much more damaging to the American society than what follows from the religious nuts in the south who want evolution replaced with creationism in textbooks
