It is murder even if they are guilty if they haven't been tried by some sort of court.
That's why the Church had the Inquisition, not the Assassination.

I know that "legalism" is basically a meme now, but saying that killing someone can only be justified if they're tried by a court first, is basically actual legalism. Especially if the people who commit such crimes are the ones that control the courts in the first place.
