@SpencerReesh they basically responded with what Wyatt said, and asking if the ACLU was officially representing Kessler. ACLU responded already saying that yes, they are taking the case. I expect ACLU will be sending more inquiries to the city, though I don't know whether they'll all be publicly posted.
ACLU is still working on their formal suit. They will be filing either today or tomorrow. We have time.

This is way bigger than we all realize, it could actually lead to the statue being legally protected if a case can be made that antiwhite sentiments are behind the removal. Jason you should make that case with ACLU

We have a track record of winning. In the 90s the ACLU did the same for WN groups denied permits.
Make no mistake it COULD be their thing if they wanted. If a MLK statue was being removed by a white vice mayor they'd be on it

I don't think they want to do that, though. They likely only take cases like this one because they want to maintain some image of not being biased in favor of lefties. Defending the statue on the basis of anti-white sentiments would place them explicitly on the right, and not just normal "conservative" right.
