The burden of proof IS on the plaintiff, which is, of course, the president. His attorneys have plenty of evidence. There are literally more than an thousand sworn affidavits as well as statistical analysis and some whistleblowers
If all of the witnesses were republicans I would say his case would be just a tad bit less strong, but there are democrats who have come forward too.
Plus there is past documentation of fraud and concerns about the voting machines from not only the republicans, but democrats as well as the MSM

I do believe that the president's case has both
Cuz I did read (upon delving into it a little further) that in most cases for civil lawsuits that it needs to be a preponderance of the evidence, but that usually for fraud it has to be "clear and convincing evidence".

Yes... for these cases though, the burden of proof might be a bit higher than in a private civil litigation because what we are talking about doing is serious
So my guess is that several legal standards will be required... we are, after all, talking about overturning an election that many believe has been finalized.
And really it's all up to the judges, I don't think there's a law that says it has to be proven by those certain amounts ?
It's just typical practice.
And the democrats will go absolutely BONKERS when they overturn it. So we will need to have overwhelming evidence
