@P0ke in an actual military setting, yes tear gas would be illegal as it would fall under the category of chemical weapons, however, like Counter Terrorism Units, Police aren't held to the same standards as military personnel

Military also aren't allowed to use hollow points but they are legal for civilians. Being illegal for military isn't a good point.

Military is supposed to fight the other side, and kill if necessary. Police are not supposed to fight and kill the opposition, so they use non-lethal alternatives to try to avoid having to go to lethal force...
