The opinion was more elegant than that. It was based on the convenient timing of the objection to the constitutionality and that American voters voted in good faith.

Yet if they guy brought the claim earlier he would’ve been dismissed for lacking standing bc he wasn’t a candidate at the time of the regulation being passed. Totally political ruling it’s horrible

To me the logic to dismiss is ridiculous. Maybe I’m biased but after reading the constitution it’s seems very clear that act 77 is unconstitutional now determining a fair remedy is the issue. If the opinion was based on the claim that’s a diff story it was dismissed bc of a procedural/technicality reason that’s why I say it’s political

I don’t think that’s the same issue. Absentee military process is understood and constitutional and a small % of the votes. For the executive and judicial branches to amend the law is totally different

It is a major problem, forget the constitutionality for a min. The management was inconsistent and poorly done. It’s one thing if they changed the rules and executed well, they changed the rules and it was a shit show.

New regs made it much harder to invalidate votes creating an incentive to just say fuck it out it thru and they decreased the sensitivity on the machines
