I'm looking around for relevant statutes on lawfully CC'ing compounded with that statute above "Failure to Disperse...etc"
If we lose the permit, you probably shouldn't have a firearm
IANAL, but once you commit a crime you're no longer lawfully CCing.
And at that point it just becomes posession of a firearm whilst in the comission of a crime.
I won't be carrying if we don't have a permit, because that opens the door to a misdemeanor which can be elevated to a felony if I'm carrying. I won't tell anybody else what to do.
According to this http://humbrechtlaw.com/unlawful-assembly-in-virginia/ you are correct.
10 years for carrying, even if you are legally, and are declared part of an unlawful assembly that gets categorized as a riot or mob.
Which is a very real possibility if we are told to disperse and/or a melee breaks out.
"In most cases, every member of the group is responsible for any crimes committed by any other member of the group."
your class 4 misdeamor will turn into a felony if you're carrying
That's the gist of it
Basically if you're gonna carry, have a good attorney.
Basically don't carry.
Is a baseball helmet no cage against the face covering law?
It doesn't have anything covering your face, and it's just a helmet?
Are helmets under the same boat as body armor @V I T A L I T Y ?
I have no idea. I am not a lawyer and don't want to hand out legal advice lol.
Helmets /should/ be fine. Ballistic armor, not so much.
As far as a helmet that has no face coverings, I don't see how that would bring the face covering law into question... since there is no face covering.
Hmmm
I'll be on the side of caution then.
I just dont want to get a head injury.
You won't get in trouble for a helmet.
TBH if we don't get the permit reinstated I would rethink coming altogether (we have a Wheatfield Dweller thing being organized away from the rally), but if you do end up coming, a helmet is the bare minimum I'd advise.
Definitely one without a face cage. Aside from the legal question, it gives people something to grab on to, and getting facemasked will fuck your neck up.
Whats the laws in virginia about keeping guns in your car. i.e. a handgun in the glovebox?
with the changing elements of recent events, I see myself leaving the CCW at home but joining with a knife and/or baton. anyone have a source on them?
Most pocket knives legal? I think theres a pin about it
Scratch that, i dont think there is,
What situation will you be in where you should use a knife but not a gun?
Swashbuckling.
Cutting boxes and rope and stuff?
Needing deadly force while in a crowd. Hypothetically speaking.
@Hand Banana I generally prefer to use a knife when I prepare food
to make sure to pass that stealth mission without setting off any alarms...
If you don't use a gun to dice up your veggies you're a faggot.
Fyi
God damnit, Leah!! Way to ruin my troll. 😉
