@Whithers Thanks for the clarification. There are many things that the gov't does overstep when it comes to various licensing. A licence/permit, according to Black's Law Dictionary, in simplest terms, is gov't permission to do some act that is overwise illegal or unpermitted. Using this as an argument, that would make something as simple as marriage unlawful unless permitted by the gov't. I see this as overstepping boundaries.

okay I'm back past where I first caught the livestream ... yeah 48 to 50 minute mark is just pure gold ... that said if you're in the jury box at the end the judge will remind you that what the lawyers said is not evidence ... the witness testimony and exhibits are evidence but not what the lawyers said

With the above example of marriage, that would make the State a party in the marriage contract. With the State being a party, it allows them to have a say in one's marriage.

@Bey Positive rights are rights that are created by statute/case law that impute an obligation on others for example, a right to health care, means that in order for you to exercise your right, you can impose on the state via taxes and or regulations that would require another person to provide health care to you whether they want to or not. A negative right i.e., freedom of speech is a right that requires no threat of force against another person in order to exercise. Another way to put it, you have the freedom to seek healthcare from any source you see fit = negative right vs. you have the right to obtain healthcare from a government approved source = a positive right.
