``` First off, no. It's no more a gang symbol than the Black Lives Matter flag. They both, essentially, serve the same purpose.
Second off, this image doesn't give correct citation of the code it's referring to. This is U.S. Code Title 4 subsection 8. Lots of interesting stuff in there in Title 4, you should read it.
Third, there is no "mark, insignia, letter, word, figure, design, picture, or drawing" featured on this flag, only a different colored fabric used for one of the allotted stripes. The only place the U.S. code talks about the colors of the flag are in defining what the U.S. flag is - So this is either not a U.S. flag, or a U.S. flag within compliance of subsection 8. Your call.
Fourth, the Flag Code is not enforced as a penal code outside of Washington DC (See §3) You can tell this by the fact that nobody in the last 3 to 4 years has left a football field under arrest for 4 U.S. Code §4. If you'd like to see the police enforce the Flag Code as punishable offenses, write your congressman! But be warned...
Bonus Point: The Flag Rules and Customs are modifiable at the President's proclamation! (4 U.S. Code §10)

Also, given the elaborate list that they include in §8, I think it's quite apparent what they're referring to. Essentially, you can't put a faction logo, advertisement, or, say, a 'No Step On Snek' overlay onto a US flag.

Well, yeah. It'd be annoying if I disagree with it, but it wouldn't be against flag code.
Basically, it's specifically against code to put a logo over it, or to use a version of it to support a company (advertising)
but using the flag to show solidarity with a movement is different.

13 stripes, that only has 6. You can argue that that's a design *change*, but a design was not placed on the flag, therefore it did not break §8. It is a separate flag.
Because you can see it as "A United States Flag but with x instead of", it doesn't fit the definition of a United States flag.
Otherwise Sweden's flag is just a Denmark flag but with a yellow cross and blue field.
