Act 77 might have been “passed” around a year before the election but it had been changed right before the election and was still in litigation up to only a few days before the election. The Laches argument is dumb. Can’t bring a case before the election because the courts rule, no standing. Can’t bring one after the election because you waited to long. Their argument isn’t NOT about fraud. It has nothing to do with it at all. Among other things, It’s arguing that due process and equal opportunity was violated. Equal opportunity, is NOT arresting people, boarding up windows, harassing and threatening poll watches. The suit is asking the court to send the election to the State legislature. The Constitution is very clear that the power to choose electors rests with the State Legislators. The people being able to vote for president, isn’t even in the constitution. We used to not even have a vote for president.

Even if SCOTUS does side with Texas on this...that does NOT mean the legislators have to send pro Trump electors.

This is the argument. Nothing whatsoever to do with fraud. Throw out the F word in this case. It’s about whether or not those states violated the state or federal constitution. The remedy IF SCOTUS agrees with TX, is very fair. Nothing to do with throwing votes out, or forcing someone to vote for President Trump instead of Biden. They are asking to send the decision to the state legislators just like the constitution actually says.
