@Storin Having studied law, I would agree with you except in this: there's a technical difference between law and statute. The technical definition of law, as used in that domain, refers to moral order (do as thou will, but harm none), as opposed to statute, which is the arbitrary whim of a legislator

Let's take your example of nukes. Everyone was worried about North Korea, right? And Iran? Let's supposing one of these regimes actually manages to take out a city. Well, we will drop the sky on them and leave their entire country a smoking irradiated, barren crater for the next five thousand years. They know it, we know it. It's why the Cold War never turned hot, and it's why - coupled with the fact that we can shoot down ICBMs - that an all-out nuclear war is unlikely to happen.

NK has nukes, but if they make peace with SK and agree to leave Japan and the US alone, neither side has beef, so why do we care at that point?

Setting aside whether FDR actually knew in advance about Pearl Harbor, you could argue we were attacked first by Japan and were justified in retaliating. The Empire of the Rising Sun was actually quite ruthless and fanatical compared to the Japanese of today. They were a lot like ISIL in their tactics of beheadings, kamikazing, and terror.
You do realize that most of the actual atrocities of the Nazis - such as the Holocaust - weren't actually discovered until more or less AFTER the war was already won, right? Like IIRC, it was the Red Army who first found the camps (and they weren't entirely trustworthy after incidents like Katyn).

Should also point out that, in WWII, the Allies bombed about as many cities of innocent civilians as the Axis did. So, we're hardly the heroes in that regard
Dresden, Berlin, Tokyo ... we bombed places that weren't even strategic military targets, mostly out of spite. In any other context, we'd be calling it a war crime
