I'm trying to find anything relating to that lawsuit actually being justifyiable, but all i'm finding in those foreign acts are
"Not allowed for Soviet/former soviet countries"
And at best all i could find thats sketchy is on page 235 of that act where it says that its allowed anyway if " President—
(A) determines that the provision of such assistance is in the national security interest of the United States;"
