Yes, in many cases it has to be treated and there are also other regulations that are at discretion.
I remember such regulations as how far an industrial business has to be away from the source of the water.
Why are they not holding him in discretion. They are just a suspect after all... not charged with anything.
Or how much off flow there can be, of what kind.
They might find evidence he isn't guilty... so we shouldn't throw away his privacy.

One issue of many open water supplies is the amount of animal feces, I remember.
There have been additional regulations due to that.
For case, there was a particular case where a deer had fallen into an open air water supply.
It had infected the water supply, because its carcass had started to rot.
There were several cases of severe sickness.

most Americans will get very ill very quick from untreated water cause we are not use to all the stuff in it

There are a lot of water reservoirs that are open to the elements.
AFAIK, this is frequent on the west coast.
