Yes, in many cases it has to be treated and there are also other regulations that are at discretion.
I remember such regulations as how far an industrial business has to be away from the source of the water.
Why are they not holding him in discretion. They are just a suspect after all... not charged with anything.

One issue of many open water supplies is the amount of animal feces, I remember.
There have been additional regulations due to that.
For case, there was a particular case where a deer had fallen into an open air water supply.
It had infected the water supply, because its carcass had started to rot.
There were several cases of severe sickness.
