We do not always have an exact proof. When we come up with a new model for a physical phenomenon, we rely on data and statistics to explain whether it is a better model or not. I would say that is merit.

Is the justification for empirical methods empirical? That would be circular reasoning. The only valid justification is praxeological, and so empiricism cannot prove anything that would contradict praxeology.
