As for the lawsuit. Every company has a download means no refund policy for the most part. The only real exception is steam. And they limit to 2 hours use or 2 weekswhichever is first. Hell even when cds were more of a thing you open it and you forfiet a refund.
Just having bugs or a massive patch doesnt negate such terms. The TOS of the sites you buy from are pretty clear on the refund policies.

you can be as faithful as you want but if the end user isn't playing it on a crt it's just not gonna be the same experience
it a reason why the hardcore retro games want to play on old hardware. you can emulate the old hardware 99% correct but that last 1% do make a difference in a lot of cases

@MountainMan In the beginning you primarily need a couple things, the bola, narcotic arrows, and a club. The narcotic arrows are optional but they will become more necessary later on, or for dinos who can't be immobilized with the bola. Every dino has a page on the ark wiki that is worth reading parts of if you think you'll keep and use the dino. It also has taming information.
As far as a server goes, I'm not 100% sure what we'll be able to do about that. Right now I'm sort of waiting for my brother to change gears from another game he's involved in before we get into ark. I know he bought a rig recently so if anything he'll probably be the one to host a server, if he can. If not, I suppose we'll just have to play on someone else's server.
Which would probably add to the experience, honestly. As long as there aren't too many people. I don't know if we're going to go the PVP route or not.
