I guess a good way to go about it would be to have much stricter regulations on things like meth and heroine because those can actually kill you from an overdose, while marijuana cannot because of the amount you would have to smoke to die is impossible to smoke in the amount of time needed.

If your method of conducting whether it should be legal or not is based off arbitariness then that's not really a good position to hold.

If gang violence is a non issue then obviously it's useless, but if it's the biggest concern then it's paramount. (Of course other drugs play a huge role too so just taking one off the list isn't going to do THAT much)
