Imagine Dankula suing his enemies for libel. Useful? Not really.
The purpose of the rule is to make people realise what they're doing is a bad idea because it gets done back to them. If someone punched me I'd have much better reasons than that to get them back
The rule works in certain contexts, but there are too many other political factors
If Dankula tried to prove the value of free speech by suing his enemies he'd just look like a hypocrite. More value in the high ground there.
