It would be a lot harder for Tim to change his brand than for them to change. They've got one game that hasn't even been released under subverse. Tim has several years worth of content.

Since Tim has Subverse trademarked and it's not a word that's used commonly I think that most courts would uphold the trademark in this scenario.

Now if they named it Subverse - the game or something then they would be fine.

I'm not sure of the context of whether the character is supposed to be a good guy or not, but looking at the show's Twitter, I'd say there's a good chance they portray him as someone the audience should listen to
