(I think the confusion here might stem from the fact many ppl don't understand that government deciding not to have a rule on a given subject is ALSO it having a rule. Because gov has the monopoly on violence it also prevents other institutions from enforcing rules. So a rule that isn't state-mandated is not only unenforced, it is banned unless there is a gov institution that says it's not.)
