...Government did not submit a statement saying why it prorogued, so court ruled based on information available to them - if they had submitted a statement, it would most likely have been thrown out.

By failing to submit statement, it is assumed nobody prepared to put their name to the official reason for prorogue.

An appeal could win fine so long as they produce a statement that clarifies reason for prorogue, and so long as there's not some document in circulation that contradicts their stated reason for prorogue.
That's why they passed legislation for all private communication to be shared regarding Yellowhammer - they looking for anything to take down the government.

yes, that's the problem - it's obvious why they prorogued, albeit proving it is a different issue - but too many people have said too much to the media to simply submit a general statement to the courts.
Misleading courts via statement is the same as lying under oath... and that has serious repercussions
