If someone cut your hat in two and didn't hurt you, then yes that'd be destruction of property but 1: you wouldn't sue him because you'd be too in awe and also probably a slight bit intimidated, 2: it wouldn't come up as a hate crime because it's an *actual* crime

if it's a crime, then it doesn't get reported as a hate crime because an actual crime has been commited
