In either case though, at least as far as I'm aware, conspiracy isn't a crime. If his possessing of a machete or other materials is illegal, then that's reason to lock him up, but ultimately the plotting isn't a crime commited yet.

You have to actually commit a crime before you can be arrested. Extensive planning is reason to surveil, but not a crime committed yet.
