This is a topic we discussed last night, but since there are different faces here it dawned on me to ask the topic once again. Would you guys be in favour of legislature that instates cheating (strictly in the cases of marriage/common law) as a crime?

If we treat marriage as any other deal, protected by law, than there should be law restriction.

personally i think that marriage should not be linked with state, only with religion

wouldn't people just cheat more because of it?

kinda like when prohibition was in place, (not very well read on specifics) but wasnt there a lot more consumption of alcohol through illegal means?

present situation when marriage is the only deal not protected but regulated is the worst solution i think

this is why gay marriage is a thing, if we would have a situation when state doesnt care about marriage, then there would not be this issue

If the cheaters get caught and prosecuted it would probably help men who are already married, but given how court favor the female more than the male, I am not sure it would help much. I'm not even sure if it would encourage women to stick with their man and vice versa, but that's just what i think

I think abolishing marriage altogether would be a better idea

The question was meant to be taken as a thought experiment where we suspend disbelief, but still the answers are adequate. I’m with @Baron Doom on marriage should just be abolished.

Besides the courts are supposed to be independent of the government

You need some rules, not necessarily a government

But you have to have taxation to pay for the courts

for that you need a govt
