Saying he could not use a firearm in self-defense in that scenario is very well saying you forfeit your right to live.

I am actually taking my lsat in January with hopes of becoming a prosecutor it’s the single most powerful position in the legal system when you look at the weight of a persons life being in someone’s hands. There’s room for discretion and alternative sentences I’ve yet to see executed from my local commonwealth attorney
But that's also why federal prosecutors have massive conviction rates.
Because they're far more thorough and unbiased imo.
