@getsumjack nice to see you.
Ikr lol
I'm in Illinois, not far from Kyle's home town, so I'm following his case. I was amazed when I saw the video of the first guy (the one who threw the bag) getting in the face of another young man who was also wearing a light green Tshirt that night. I truly think the initial start of it was mistaken identity.
I work with some people who commute from Antioch. One has kids that know him.
well, Rosenbaum did shout "kill me, nixxa!"
so I am amazed they didnt charge him with illegal assistance of suicide.
😂
@Beth, you just advanced to level 16!
1st degree Euthanasia
Haha
I was thinking: perhaps the reason the DA was pushing so hard on the firearms charge is to prove he was committing a crime and invalidate his self defense claim. Either that or they think that is the only thing they stand a chance of convicting him on.
They tried to get him on transporting the rifle over state lines but it came out that wasn't the case. The rifle was bought locally.
a firearms charge does not invalidate self defense claims, I believe.
It wouldn't likely no.
Unless he was perhaps a felon, and people knew he was a felon.
But generally you can't just take some hearsay as probable cause enough to conduct any sort of citizen's arrest.
Because I believe there are a few cases of convicted felons using firearms getting off on self defense.
I remember Gruler Esq went over this.
its why I joined I think.
the lecture on what removes and reinstates the right to self defense under state law.
it was a very good lecture.
Basically when you start violating other people's rights.
its not that different from here.
If you are part of the escalation you do not have the right to self defense.
if you then stand down and remove yourself, that right is reinstated.
Basically.
Though escalation is definitely something that is more grey here.
As quite a few places allow you to shoot someone for punching you.
Sometimes even if they threaten violence upon you and you are in reasonable belief that they are imminently about to attack you.
This is why we say don't brandish weapons. If you're going to unholster your weapon, you damn well better be about to shoot someone.
not different from here, except that we have an omnipresent duty to withdraw.
brandishing weapons no longer works. The protocols have to be changed after Rittenhouse.
it used to be a part of LE protocol to demonstrate lethal.
Kyle wasn't brandishing.
that is not what I mean.
Long rifles are a bit different.
