in this case I mean.
According to the "child law" you just quoted a 17-y-o. cant have a firearm. According to the...what was it...hunting laws, he/she can.
as the first one does not have the exceptions of the latter written into it (which is the norm here), is that solved by hierarchy?
or context?
the statute has different sections, one is for hunting , the other is for possession or control of a firearm, in any case 16-17yr olds are totally omitted from the statute
nope. different laws.
or....you call it "chapters" I think.
the law in Wisconsin is you can possess a rifle or shotgun (not a SBS), if you are 16+, 14-16 if you have passed hunters safety, thats the training requirement for CCW here also
sub-sections
I was asking about the hierarchy of Wisconsin law. How it operates.
its done by omission
that makes no sense.
compare the 2 subsections
you cant have a hierarchy by omission. You can have it by law or by presedense.
Why is everyone fixated on Rittenhouse? Is everyone scared to defend Freedom? Is everyone scared of dying on the front lines of defending Democracy? And, I'm not referring to being violent I'm referring to protesting strong and refusing to accept what is going on in The Country that every goddamn being on the planet wants to come to and of which many have
i wasnt referring to hierarchy
@Massie1223 I am not, I am here to learn law.
no im a firearms instructor thats lived in Wisconsin for 40 years
And Rittenhouse is an interesting case. I am not here not learn anyones opinion, with the exception of professionals.
@Beth I am! But we all regard you as special. Every rule has an exception. 😄
thats fairly accurate,....
Defenses to prosecution under this statute:
Target practice under the supervision of an adult
Members of armed forces or police under 18 in the line of duty
Hunting (either with an adult or having passed hunter's safety)
The minor was 16 years of age or older, not in violation of laws on short-barreled rifles or shotguns, and was in compliance with regulations on hunting, if hunting
a key part is the last if you are hunting, the law isnt just for hunting like some seem to think, the silly Kenosha DA said that, and they are just parroting him
also if you are age 14-16 you can possess a rifle or shotgun, but only if you have taken hunters safety, hunters safety is a training requirement for CCW here also
thats probably why some conflate it with just hunting
Came across this video last night and finally watched it earlier this morning. A pretty solid breakdown of the chain of events with some extra background information. https://www.youtube.com/watch?v=Z3IaFV_l2-k&bpctr=1607953168
yeah ive watched many, pretty clear self defense imo
oh wow a lefty Bernie voter, should be interesting
He has some bias in the text in the vide between clips, some assumptions, and some bias that's easily noticeable, but I believe he was pretty fair and even-up in his breakdown.
@DeathRhodes666, you just advanced to level 5!
thanks for sharing it
No problem 🙂
