Well yes, I'm pretty sure everyone knows there are exceptions to the first amendment.

Page 1 of 48 for a trial. Should I press A to accept that I've read it.

Who ...tf reads a star wars xbox video game user agreement?

How are these not one sentence? We are going to collect your data, and you're going to like it.

It's the Panic you caused by a Lie or Deception.

2020-12-13 20:24:18 UTC

Causing a panic that gets a bunch of people hurt can be charged as "disorderly conduct" or something like that... so its the act not the word that is illegal.

But some might try to say well the First Amendment protects me because I can say whatever I want.

2020-12-13 20:24:39 UTC

Actually no.... even lies can be protected speech by the 1st Amendment

2020-12-13 20:24:46 UTC

My point being context is 👑

2020-12-13 20:25:05 UTC

Exactly, and you can't use Free Speech as a Defense.

2020-12-13 20:25:52 UTC

Pretty sure it's a far more serious charge than disorderly conduct.

2020-12-13 20:26:01 UTC

It is actually very commonly excepted that the free speech protection in the First Amendment can protect lies.... Just watch Tucker Carlson or Hannity

2020-12-13 20:26:05 UTC

hehe

2020-12-13 20:26:08 UTC

Your honor. I said give me the money to the clerk to exercise my first amendment right! I wasn't trying to rob the bank!!

2020-12-13 20:26:31 UTC

If your Lie causes Damages it's not Protected.

2020-12-13 20:26:57 UTC

Obviously, I am just being funny about Tucker Carlson.... but it is absolutely true that Lies can be protected Speech

2020-12-13 20:27:00 UTC

Unless your name is Jussie Smollette (sp?)

2020-12-13 20:27:17 UTC

Just an example of what the charges would look like.

2020-12-13 20:27:25 UTC

It can very well be a fairly serious felony.

2020-12-13 20:27:35 UTC

Depending on how it ends up playing out.

2020-12-13 20:27:45 UTC
2020-12-13 20:27:46 UTC

White Lie (Pun intended).

2020-12-13 20:28:39 UTC

Whaaaaaaaa!?!?!?!

2020-12-13 20:28:43 UTC

I read your post too fast and began replying 😂. I read it and processed mentally (legality) missed the damage (cost) part.

2020-12-13 20:28:56 UTC

No. I disagree. I think the lies that Tucker Carlson spreads cause all manner of harm but some of it is protected.

We also have to understand that I (a private person) cannot generally violate your First Amendment rights by keeping you from saying something.

2020-12-13 20:29:09 UTC

Haha I know 👀

2020-12-13 20:29:09 UTC

Not entirely true.

2020-12-13 20:29:18 UTC

They finally got this woman in custody to question her... it's about time... at least we know that they're doing something

2020-12-13 20:29:34 UTC

Make Chicago Great Again!

2020-12-13 20:29:43 UTC

Baby steps 😍

2020-12-13 20:29:54 UTC

😂

2020-12-13 20:29:56 UTC

That's all we can hope for... lol...

2020-12-13 20:30:44 UTC

Remember, in the context of law, a lie isn't a determiner of intent. It's a stated falsehood of which a belief system exists, or there is gross negligence.

2020-12-13 20:30:47 UTC

I'm speaking in general to the Theater example.

2020-12-13 20:31:20 UTC

Belief is actually a fairly strong defense in the legal system.

2020-12-13 20:31:23 UTC

@Maw , I think is seeing what I mean.

Harm is not really the issue. The issue is whether the speech is protected. Meaning the TYPE Of speech. If it is political speech or religious speech then generally it is going to be protected by the 1st Amendment.

Even if real harm comes from it......

2020-12-13 20:31:28 UTC

This is why we generally call it good faith vs bad faith.

2020-12-13 20:31:31 UTC

You guys should probably watch that valuetainment interview before you get your hopes up for the criminal legal system.

.....I say unironically on a criminal case lawyers discord.

2020-12-13 20:31:35 UTC

And bad faith is exceptionally difficult to prove.
