generally speaking sex is determined by sex chromosomes, intersex etc. are formational defects during the embryonic period or rather genetic defects. Either way if I karyotype these persons i can define them as male or female. You can have a defect however larger defects or absence of certain parts or entire chromosomes tends to not be compatible with life and or produces infertility. Hence why properly sexing intersex or hermaphroditic individuals is vital, not only because of fertility but also because of development post nataly.
