Those asshats that sued the baker in CO were asshats

2018-10-28 20:51:51 UTC

Go somewhere else for your cake, nitwits

2018-10-28 20:51:56 UTC

How's that going to be attacked? Do you really think the supreme court is going to overturn the civil rights act? I haven't heard any serious proposals to even consider something like that.

2018-10-28 20:52:24 UTC

BUT, what happens if you are the only grocer in town? The owner of the only apartment complex?

2018-10-28 20:52:25 UTC

The Religious grounds wouldn't fly in court nor would sexual orientation, despite what the CTRL-Left claims, but would they have sued a Muslim Bakery for not wanting to make a custom wedding cake for a same sex couple?

2018-10-28 20:52:38 UTC

What happens when those people can deny service?

2018-10-28 20:53:05 UTC

Well, the cake bakers showed there is a right to deny service to GLBT

2018-10-28 20:53:16 UTC

"I don't serve Jews, get out of my hospital"? Yeah, that wouldn't be great.

2018-10-28 20:53:24 UTC

So this is law that will be examined over the next 5ish year or longer

2018-10-28 20:53:38 UTC

@DrYuriMom Yeah, we agree there. When there's only one option and the business won't provide a standard service, there's a potential for trouble.

The Masterpiece decision is extremely narrow, it only really applies to this specific instance.

2018-10-28 20:53:47 UTC

@Bookworm , exactly what will be examined now

2018-10-28 20:54:24 UTC

I know the Masterpiece decision is narrow, but that's because the court was divided. Now, well it'll be interesting.

2018-10-28 20:54:42 UTC

It's why I'm 10th Amendment Cat

2018-10-28 20:54:43 UTC

They denied special premium services. They offered basic services that are open to anyone (Buy a cake) but any store can say no to a custom job for any number of reasons

2018-10-28 20:55:01 UTC

That's a step forward I could back

2018-10-28 20:55:07 UTC

Let each state experiment within some basic groundrules

2018-10-28 20:55:08 UTC

Leaving it to states or lower

2018-10-28 20:55:35 UTC

Yeah, I think politics has become far to nationalized and it's driving the polarization.

2018-10-28 20:55:42 UTC

Consitutionality seems basically lost at this point, though

2018-10-28 20:55:46 UTC

It does.

2018-10-28 20:56:14 UTC

And I never thought I'd see a serious challenge to the 1st in my lifetime. But I can say the academic left really does want a hate speech exemption.

2018-10-28 20:56:14 UTC

Oberfell essentially takes the feds out of it. That was important. Everything else will be examining to what extent religious freedom can allow discrimination.

2018-10-28 20:56:36 UTC

I think it'll go pretty far

2018-10-28 20:56:49 UTC

? Oberfell prevents states from barring marriage licenses to LGBT couples.

2018-10-28 20:57:08 UTC

I do not want any new limit on 1st Amendment

2018-10-28 20:57:13 UTC

That's a pretty big example of federalizing as I can tell.

2018-10-28 20:57:14 UTC

1st Amemndment is life

2018-10-28 20:57:26 UTC

You're an interesting person

2018-10-28 20:57:31 UTC

I can see why you class yourself a centrist

2018-10-28 20:58:00 UTC

Me neither. Absolute freedom of speech can never be abridged nor abrogated for a free and equal society. Anything else risks soft takeover.

2018-10-28 20:58:15 UTC

The first Amendment is what allows us to say something is wrong or right, the Second Amendment is what allows us to defend ourselves from those that would take away the First.

2018-10-28 20:58:16 UTC

My understanding. The baker in question did deny to make a custom wedding cake due to religion, he instead offered his generic options of what he had in store.
It is on par with the law that you can not deny customers on race, religion, etc, for goods available to the general public.
Is that the law they want to change, or am I misunderstanding your concerns ?
@DrYuriMom

2018-10-28 20:58:45 UTC

The absolutist terms of the amendments means it really bugs me when we legislate caveats into them and pretend it's fine.

2018-10-28 20:58:49 UTC

Yeah, I hope you feel welcome around here 10th Amendment. This can be a kinda brutal place and people can get heated. But I think people aren't as angry as they can come across.

2018-10-28 20:59:02 UTC

@4AM_critter 🐉 , I'm totally comfortable with the decision within the limits as ruled

2018-10-28 20:59:04 UTC

Like, if the state punishes me for lying about another person, that's a breach of the 1st amendment.

2018-10-28 20:59:19 UTC

Again, the litigants were asshats

2018-10-28 20:59:32 UTC

Classic test case.

2018-10-28 20:59:46 UTC

I never quite understood why you'd want a custom cake from someone who clearly doesn't share your joy

2018-10-28 20:59:48 UTC

Did you hear they took the same bakery to court again shortly thereafter?

2018-10-28 20:59:53 UTC

It's like asking for an inferior product
