Also, while a lot of samples do go uncleared and unnoticed, copyright law is pretty clear on sampling. There’s been plenty of lawsuits over samples and it’s often times cheaper and easier to actually get rights to make a cover and have someone entirely replay the sample than it is to get sampling rights for the original song.
