A young East Bay man, who federal prosecutors say spoke of unleashing a wave of violent terror attacks across the Bay Area, pleaded guilty on Tuesday to providing material support to a foreign terrorist organization by opening multiple social media accounts for two ISIS sympathizers.
Berkeley High School graduate Amer Sinan Alhaggagi, 23, entered the guilty plea in a federal courtroom packed with family members โ almost a year after originally pleading not guilty last August.
Alhaggagiโs attorney, Mary McNamara, said under the law, any support to a terrorist group โ no matter how minor โ makes a person guilty. She said there is no defense for her clientโs decision to open the social media accounts but stressed all he did was open the accounts. She said he never planned to carry out any attack.
โThis is whatโs happened in the country since 9/11,โ McNamara said. โIt captures people like Amer, who is a young, immature guy who never intended to do anything.
He said some foolish things online and the FBI sent out their best and brightest to do a sting operation,โ she added. โThe FBI was doing their job โ weโre not saying they didnโt do their job. But they failed to get him to do anything. To that extent, I think Amer Alhaggagi was low hanging fruit here, and I think itโs an awful tragedy.โ
Alhaggagi could face nearly five decades in federal prison for the creation of those social media accounts, and three other charges related to credit card fraud and identity theft. Friends and family of Alhaggagi who showed up to court declined to be interviewed, but said in a statement they hope the judge will understand that he is not a terrorist or violent person, despite some of the claims he made online.
โAmer did not plan a violent act,โ Alhaggagiโs family wrote in the statement. โWhen he was encouraged to take action by an undercover agent, he ran away. Amer is pleading guilty to opening a handful of Twitter and Facebook accounts for ISIS sympathizers. We are Americans with great faith in our justice system, and we have great hope that the judge will understand that Amer is not dangerous or a threat to others and should be sentenced accordingly.โ
Federal prosecutors did not talk after the hearing, but they painted a much darker picture of the young man in court records. They allege Alhaggagi conspired to kill thousands of people across the Bay Area by blowing up gay night clubs, planting explosives on the University of California, Berkeley campus, and setting fire to the Berkeley Hills.
It was the reference to the Berkeley Hills that prosecutors say allowed agents to narrow in on Alhaggagi. Initially, undercover agents were unaware of his real identity or where he lived.
During a December detention hearing, federal prosecutors recounted online conversations they say Alhaggagi had with FBI informants posing as ISIS sympathizers.

Iโm going to plant a bomb in a gay club. By god, Iโm going to tear up the city. The whole Bay Area is going up in flames.โ
When Alhaggagi allegedly claimed he would join a local police department to steal weapons if he couldnโt make bombs himself, investigators began contacting Bay Area law enforcement agencies in a hunt for any leads. They eventually found an application that Alhaggagi had submitted to the Oakland Police Department, trying to become an officer.
The FBI then used an undercover agent posing as an ISIS sympathizer to make direct contact with Alhaggagi, according to court records. Prosecutors say Alhaggagi took that agent on a tour of the Bay Area to point out possible targets for an attack.
But court records also show Alhaggagi later broke off contact with the agent. McNamara said that shows her client never actually intended to carry out a terrorist plot.
โAt the time, Amer had barely turned 21,โ McNamara told NBC Bay Area after Alhaggagiโs arraignment last year. โOur understanding is that the undercover agent was far older and the sorts of discussions that were had, I think for an impressionable young man like Amer, went beyond what he was comfortable doing.โ
Alhaggagiโs friends and family who spoke to NBC Bay Area last year said they were blindsided by his arrest.
It doesnโt jibe, frankly,โ said Alhaggagiโs uncle, Hashem Awnallah. โIt doesnโt add up because thatโs not the person we know.โ
Alhaggagiโs friend, Suhaib Ahmed, had a similar reaction.
โEverybody that I know was completely baffled,โ Ahmed said. โBecause this person, we know him to be an amazing, kind-hearted soul.โ
Alhaggagi's sentencing is expected to take place this fall. NBC Bay Area will continue to update this story as we learn more.

ORANGE COUNTY, Fla. โ
One person has died after the occupants of two vehicles exchanged gunfire Thursday afternoon on a busy road near the University of Central Florida campus, police said.
Officials with the Orange County Sheriff's Office said gunfire was exchanged between people in two vehicles on Alafaya Trail, just north of Colonial Drive around 1 p.m.

One of the vehicles involved crashed near the RaceTrac gas station on Alafaya Trail.
Deputies said the driver was taken to a hospital for treatment, but did not survive. The passenger was not hurt and has been taken into custody for questioning.
Authorities are still searching for the other vehicle involved in the shootout. Deputies said it is a white, four-door Nissan Altima with dark tinted windows and bullet holes on the driverโs side.
UCF police said the people involved do not have any connection to UCF and said they do no believe there is any threat to the campus.
Anyone who witnessed the incident is asked to contact the Orange County Sheriffโs Office.
