I think even in that sense it's not that clear cut
punishment for what
what does it matter?
seems... pretty rough that your sister should be raped because you stole a crate of grapes
curiosity?
equally rough if you killed a man
yeah, i can't think of any crime that punishment would fit, so i'm just curious where their value system places it
I am not intimately familiar with local determinations of the appropriateness of sibling rape as a punishment
^cheating
if you cheat on your husband that seems to fit punishment.
Kinda uhh...
what
I mean, I get the logic.
you cheat on your husband so your family gets raped as your punishment?
It just seems that it creates a form of justice at the expense of another form of injustice
And I'd say forcible rape is more unjust than adultery
not that it would ever really be acceptable to produce a legal remedy which is at once an injustice to a third party, and justice for the plaintiff.
and ass rape seems fit punishment if you rape someone.
I'm not sure what kind of f'd up punishments there are in some kind of Islamic country, but I'm not going to bother my head about them in our countries.
Well, I can think of circumstances where that may not function
you'd go around raping girls
and enjoy getting fucked in the ass later that day
There were cultures with cannibalism. That doesn't mean I am going to worry about the cultural impact of cannibalism in New York.
Rape has been a crime that was punishable by death since the earliest day of western society. That's enough for me.
i would be really worried if there was cannibals in my city...
I now feel that the term "perverse incentives" has been overused, and no longer holds the crucial meaning I intend it to impart in this particular case.
I think its good to know things
@Undead Mockingbird it's not quite that simple though
@Undead Mockingbird because differential enforcement is kinda the problem
I would agree that modern western countries tend to fairly punish rapists
Well, differential enforcement is a problem for every crime under the sun.
We treat rape differently, though, because our primary concern is how it relates to WOMEN.
Because it's a crime that is seen to particularly affect women, we treat it differently.
but in the west, the nominal penalties for rape were not the ones that were applied to _some certain persons_
We are even willing to throw due process over board, which we would not even do for MURDER. So where is our concern for not enough people being convicted for murder?
Are we running around every day talking about how OJ Simpson should have been convicted and how due process lets too many people off the hook for murder?
OJ would disagree with that assessment
I'm just saying that it is more understandable when some people in India complain, however incorrectly, that due process should be circumvented.
