while vehicular manslaughter would be under that, 1st degree is extremely specific and has a very large requirement of forethought that exceeds what I've seen in this. Would take a single person to doubt it was planned in advance to crumble. That is a big reason why even in the cases that are clearly 1st degree that they almost never pursue 1st degree, because proving intent to an entire jury is basically impossible in a real trial (show trials are another thing)
