there are only 3 intents for yelling fire in a theatre: 1. there's a fire, 2. malicious intent, 3. stupidity of some sort. you've already shown you think someone's stupidity can be a punishable offense, the first shouldn't be illegal, the second should, the third should be anyway, like manslaughter vs murder. a person is dead regardless of intent
