it says that it is done with intent, malice aforethought. Malice means that it's not a consensual event, it is regardless of the wishes of the other person, as opposed to an assisted suicide in which case the death was consented to and accepted

because for something to be done "with consent" at least implies very heavily that it is not done with malicious intent. if something is done maliciously it won't matter if the other person wants it or not, and is HIGHLY unlikely to have consent given in any capacity. there is a fringe case of a person actively and with malice attempting to kill someone and during the event the person agreeing to it, but that's irrelevant to the choice of the killer at that point
